Article
In accordance with RSA’s 31:39, 41:11, 47:17 VII, 236:20 the Town of Newton hereby adopts the following Ordinance to regulate snow and ice removal and disposal upon any Town roadway including all right of ways thereof in order to provide for the promotion of public health, comfort, convenience, safety, welfare, prosperity and the peace and quiet of the Town and its citizens.

Section 1:      Purpose and Intent
The placement of ice and or snow on Town right of ways causes detrimental affects on public health, comfort, convenience, safety, welfare, prosperity and the peace and quiet of the Town and its citizens.  Therefore, the Town ordains it necessary and appropriate to enact the following provisions and prohibitions.

Section 2:      Prohibited and Authorized Parking
Prohibited:  Within the Town of Newton, it shall be unlawful for any person to put or place or cause to be put or placed any snow or ice upon any roadway, sidewalk or any and all right of ways thereof.

Authorized:  Town departments may be excluded from this requirement when done in compliance with their official duties or in compliance with direction from the Board of Selectmen or Newton Road Agent.

Section 3:      Violations and Penalties
Violation of this section may result in a penalty not to exceed $500.00 and/or the cost incurred in removing said obstruction.

Section 4:      Severability
Should any provision of this Ordinance be held invalid by any court of authority or competent jurisdiction, such holding shall not effect, impair or invalidate any remaining provisions which shall remain in full force and effect.  To this end, the provisions of this Ordinance are severable.
